Expert Report & Testimony: Environmental Impact Assessment
Gunnison County, Colorado
Western Water & Land was retained by Gunnison County to provide litigation support services in relation to a case involving the construction of a 1.2-mile long road adjacent to an active stream channel without the required county permits. The County was concerned that the road building actions taken by the landowner was causing adverse environmental impacts and that mitigative measures were required to reduce those impacts. Western Water & Land conducted a site inspection and prepared a report documenting assessment of the environmental impacts attributed to the road building, with an emphasis on water resources, and providing recommendations for remediation of the impacted areas and mitigation of future impacts. In a stipulation with the County, the landowner agreed to implement the recommendations presented in the Western Water & Land report. Based on a follow-up site inspection and supplemental report by Western Water & Land, the Court found that the landowner was not in compliance with the Stipulation and was subject to a Stop Order for violation of the Gunnison County Land Use Regulations.
